Report on the Societies’ anti-piracy activities

On a yearly basis, BIEM member societies update their information regarding the national situation in the fight against piracy. In this part of the website, you will find a summary of BIEM's societies' activities as published in the 2022 Business Affairs Report and members' responses showing the situation on a country-by-country basis.

In 2022, more than two-thirds of BIEM member societies have taken part in the annual survey on antipiracy activities. The purpose of the study is to gather information on the latest developments in member societies' countries. According to the information received, the 2021 results are aligned with the previous year’s, presenting increased access to online content as well as in-use and illegal sharing of protected content, particularly on social networks. The 2021 MUSO report, which focuses on piracy data, revealed that the number of visits to sites offering illegal content (TV, films, music, books, newspapers, and magazines) had increased by 12% compared to 2020. This trend could go on in the current context of economic tightening and rapidly rising inflation.

The CIAPC survey confirms that the use of legal services has continued to increase in 2021, as 62% of respondents point out that they use at least one legal internet service. However, 9% approve of accessing illegal streaming content, and 26% approve of accessing unauthorised content on YouTube or a similar service. The IFPI report, based on its survey of 43,000 internet users in 21 countries, highlights that available illegal music still represents a concern for the music industry, as almost 30% of respondents admit to having used illegal means to download or listen to music.

Guidelines for Notice & Takedown (NTD) Letters

These BIEM/CISAC Guidelines summarized major elements which might be considered as benchmarks by societies when drafting their own NTD letters. However, not all of the elements proposed in the guidelines should necessarily be put in the letters at the national level, as these national letters should as a priority comply with the national legislation in force.
