GEMA vs IFPI - Arbitration Proceeding on the conditions applicable to TV advertised Products - 12% TV ticket

The Arbitration Bureau of the German Patents and Trademarks Office has rejected the IFPI Germany’s claim that GEMA, like the other copyright management societies in Europe, should apply a discount to the normal rate of remuneration, especially for audio carriers which are advertised in the media. At the end of the arbitration procedure being held since 1997, the Arbitration Bureau indicates in its decision that the granting of a 12% rebate of this type would result in an unfair level of remuneration for audio carriers in Germany.
