GEMA vs IFPI - Arbitration Proceeding on the conditions applicable to Music Video DVD & VHS

The Arbitration Board issued its decision on 9 November 2005, proposing a contract applicable from 1 January 2002 to 31 December 2007, based on a rate of 6.99% of the PPD with no pro rata and with the same provisions as those for CDs as regards the minimum royalties.
The reference had to be formulated contractually but this had given rise to a dispute between GEMA and the German group of IFPI over the limitation of the number of works and fragments. IFPI and GEMA had initially agreed to clarify this issue before the Arbitration Board but IFPI had subsequently changed its mind. As a result, the November 2005 settlement proposal had become final.
